1. Acceptance of Terms

By accessing, browsing or using the Wild Irish Bloom website at wildirishbloom.ie (the "Website"), you confirm that you have read, understood and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms form a legally binding agreement between you and Wild Irish Bloom.

You must be at least 18 years of age to place an order or create an account on our Website. If you are under 18, you may only use the Website under the supervision of a parent or legal guardian who agrees to these Terms on your behalf. By placing an order, you confirm that you are at least 18 years old or that a parent or guardian has authorised the transaction.

We reserve the right to refuse service to anyone, at any time, for any reason that is not prohibited by Irish or European law. Your continued use of the Website following the posting of any changes to these Terms constitutes acceptance of those changes.

2. Description of Services

Wild Irish Bloom is an online garden centre and rewilding resource hub based in County Clare, Ireland. We specialise in the following products and services:

• Native Irish wildflower seeds and seed mixes — Irish provenance wildflower seeds suitable for meadow creation, border planting and container gardening across Ireland's diverse soil types and climatic conditions.
• Native plug plants and potted wildflowers — nursery-grown native Irish plant species, including species suited for pollinator gardens, bog gardens, coastal gardens and woodland edges.
• Wild edible plant seeds and collections — curated seed kits for growing wild garlic, wood sorrel, wild strawberry, chamomile and other native edible species in Irish gardens and allotments.
• Peat-free compost and growing media — sustainably sourced, peat-free compost blends specifically formulated for native wildflower establishment in Irish soil conditions.
• No-dig gardening tools and accessories — copper tools, biodegradable pots, mulching materials and equipment designed for regenerative, no-dig gardening methods.
• Wildlife habitat products — bee hotels, hedgehog houses, bird boxes, insect shelters and log pile kits to support biodiversity in Irish gardens.
• Rewilding kits and starter bundles — complete garden rewilding packages containing seeds, compost, habitat products and detailed planting guides.
• Free wild gardening advice — personalised planting guidance provided by our horticultural team via email and telephone, offered as a complimentary service alongside product purchases.

All products are described as accurately as possible on the Website. Photographs are representative of the species or product type but may show plants at different stages of maturity or in different growing conditions than those in your garden. Natural products such as seeds and plants are living organisms whose performance depends on soil, weather, planting technique and ongoing care. We cannot guarantee specific germination rates, growth outcomes or flowering times, as these are influenced by factors beyond our control.

3. User Obligations

When using the Wild Irish Bloom website, you agree to the following obligations:

• Lawful use only. You will use the Website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Website by, any third party.
• Accurate information. You will provide accurate, current and complete information when placing an order or contacting us. You are responsible for maintaining the confidentiality of any account credentials.
• No automated access. You will not use bots, scrapers, crawlers or other automated means to access, copy or monitor any part of the Website without our prior written consent.

4. Orders and Pricing

4.1 Placing an Order

When you place an order through our Website, you are making an offer to purchase the selected products at the listed price. An order confirmation email does not constitute acceptance of your order. A binding contract between you and Wild Irish Bloom is formed only when we dispatch your order and send you a dispatch confirmation email.

We reserve the right to refuse or cancel any order for any lawful reason, including but not limited to: product unavailability, pricing errors, suspected fraudulent activity, or inability to verify your identity or payment information. If we cancel your order after payment has been taken, we will issue a full refund to the original payment method within 5 working days.

4.2 Pricing

All prices displayed on the Website are in Euros (€) and include Value Added Tax (VAT) at the applicable Irish rate. We make every effort to ensure that prices are accurate at the time of listing. However, errors may occasionally occur. If we discover a pricing error after you have placed an order, we will contact you to inform you of the correct price and give you the option to proceed at the corrected price or cancel your order for a full refund.

We reserve the right to change prices at any time without prior notice. Price changes will not affect orders that have already been confirmed with a dispatch notification.

4.3 Delivery

We deliver to all 32 counties in the Republic of Ireland and Northern Ireland. Standard delivery is €4.95 per order. Delivery is free on all orders over €55. Priority next-day delivery is available for addresses in the Greater Dublin Area, County Clare and County Galway, subject to ordering before 12:00 noon on a working day. All other areas typically receive orders within 2 to 3 working days.

Delivery times are estimates and are not guaranteed. We are not liable for delays caused by courier services, adverse weather, public holidays, or circumstances outside our reasonable control. Live plants and perishable items are dispatched Monday to Wednesday to avoid weekend transit delays.

4.4 Returns and Refunds

Under the European Union (Consumer Rights) Directive 2011/83/EU, as transposed into Irish law by the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 (S.I. No. 484 of 2013), you have the right to cancel your order within 14 calendar days of receiving your goods, without giving any reason. To exercise this right, you must notify us in writing by emailing [email protected] or by post to our registered address.

Due to the perishable nature of live plants and seeds, the following exceptions apply:

• Live plants that have been planted or removed from their original packaging cannot be returned.
• Opened seed packets cannot be returned for hygiene and biosecurity reasons.
• Custom or personalised seed mixes are excluded from the right of cancellation once preparation has commenced.

For non-perishable goods (tools, compost, habitats, accessories), items must be returned in their original condition and packaging within 14 days. Return shipping costs are the responsibility of the customer unless the item is faulty or we have sent the wrong product. Refunds will be processed within 14 days of receiving the returned goods.

If you receive damaged, defective or incorrect items, please contact us within 48 hours of delivery with photographs and your order number. We will arrange a replacement or full refund at no cost to you.

5. Intellectual Property

All content on the Wild Irish Bloom website, including but not limited to text, photographs, illustrations, graphics, logos, icons, video, audio, software, planting guides, articles, product descriptions and the design and layout of the Website, is the property of Wild Irish Bloom or our licensed content partners. This content is protected by Irish and international copyright, trademark and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Website for personal, non-commercial purposes. This licence does not permit you to:

• Copy, reproduce, republish, or redistribute any Website content for commercial purposes.
• Modify, adapt, translate or create derivative works based on any Website content.
• Use any data mining, scraping or similar data gathering or extraction methods.
• Remove or alter any copyright, trademark or proprietary notices from downloaded materials.

The Wild Irish Bloom name, logo and associated branding are unregistered trademarks of Wild Irish Bloom. Use of these marks without our prior written consent is strictly prohibited.

6. Disclaimers

The Wild Irish Bloom website and all products, services, content and materials provided through it are offered on an "as is" and "as available" basis. While we take great care to provide accurate product descriptions, planting advice and gardening guidance, we make no representations or warranties of any kind, whether express, implied or statutory, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose.
• Warranties that the Website will be uninterrupted, timely, secure or error-free.
• Warranties regarding the accuracy, reliability or completeness of any content, planting advice or product information.
• Warranties that seeds will achieve specific germination rates or that plants will thrive in your particular soil, climate or garden conditions.

Gardening involves inherent variables, including soil quality, weather patterns, pest and disease pressure, and individual growing practices. Our planting guides and wild gardening advice are provided in good faith based on our professional experience in County Clare and the Greater Dublin Area, but they cannot account for every variable in your specific location. We strongly recommend consulting local soil analysis and climate data for the best results in your garden.

Nothing in these disclaimers affects your statutory consumer rights under Irish law, including the Sale of Goods and Supply of Services Act 1980 and the European Union consumer protection regulations.

7. Limitation of Liability

To the fullest extent permitted by applicable Irish and European Union law, Wild Irish Bloom, its directors, employees, agents and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to:

• Loss of profits, revenue or business opportunities.
• Loss of data or goodwill.
• Damage to gardens, property or plants resulting from following our advice or using our products.
• Any damages arising from circumstances beyond our reasonable control (including weather events, pest damage or soil conditions).

Our total aggregate liability to you for any claim arising out of or relating to these Terms, the Website or any products purchased shall not exceed the total amount you paid to Wild Irish Bloom for the specific order giving rise to the claim, or €500, whichever is lower.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Irish law.

8. Indemnification

You agree to indemnify, defend and hold harmless Wild Irish Bloom, its directors, employees, agents and suppliers from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Website or any products purchased from us.
• Your breach of these Terms or any applicable law.
• Your violation of any third-party rights, including intellectual property rights.
• Any content or information you submit to us through the Website, including inaccurate order information.

This indemnification obligation shall survive the termination of your use of the Website and any order you place with us.

Any dispute arising out of or relating to these Terms, or your use of the Website or products purchased from Wild Irish Bloom, shall be subject to the exclusive jurisdiction of the courts of the Republic of Ireland.

If you are a consumer resident in the European Union, you may also benefit from mandatory consumer protection provisions of your country of residence, and nothing in these Terms affects your right to rely on such provisions. 12. Dispute Resolution

We commit to acknowledging your complaint within 2 working days and providing a substantive response within 10 working days. Many issues, particularly those related to damaged products, delivery delays or order errors, can be resolved quickly through direct communication.

If an informal resolution cannot be reached within 30 days of your initial complaint, either party may initiate formal proceedings. For disputes not resolved informally, you may refer the matter to mediation through a mutually agreed mediator in Ireland. If mediation is unsuccessful or not pursued, the dispute shall be resolved through the courts of the Republic of Ireland as specified in Section 11.

Nothing in this clause prevents you from exercising your statutory rights as a consumer or filing a complaint with the Competition and Consumer Protection Commission (CCPC) in Ireland.

13. Termination

We may suspend or terminate your access to the Website, in whole or in part, at any time and without prior notice if:
